Carl Hagwood obtained summary judgment recently in a medical malpractice case filed against a pediatrician in Clarksdale, Mississippi.
The Plaintiffs alleged that the pediatrician was negligent in not making a proper referral of an infant who sustained a brachial plexus (ERB palsy) injury at birth.
Summary judgment was obtained on the ground that Plaintiffs had not established a causal connection between the alleged negligence of the pediatrician and the lack of improvement in the infant’s use of her left arm. The case was pending in the Circuit Court of Coahoma County, Mississippi.
