Phillips, Eaton Speak at THCA

        Michael Phillips and David Eaton spoke at the Tennessee Health Care Association annual conference Aug.17 in Nashville.

        The purpose of their presentation, “Defending the Nursing Home at Trial: Educating Jurors on the Medicine Trumps the Corporate Greed Theme” was to emphasize that Nursing Home negligence cases can and are won at trial.

       Actual trial cases were used to demonstrate how to best rebut plaintiff’s theory that corporate greed leads to organizational chaos at the facility and harm to the residents by instead focusing the case on the medicine.

       The presentation concluded with an emphasis on the importance of educating the jurors
on the medicine and the predictable course diseases follow which often results in the development of pressure sores, weight loss, amputations, infections, and death.

       This was the second year Mr. Phillips and Mr. Eaton were asked to speak at THCA. Their presentation last year was entitled “How Dietary Issues Affect Litigation.”
