The Mississippi Defense Lawyers Association published an article by Bradley K. Overcash
entitled, "Historical Context Important in Defense of Clients Under the MTCA" in the Spring 2010 edition of The MDLA Quarterly. In the article, Mr. Overcash sets out a strategy for defending hospitals owned by state and local governments and other governmental entities.
Mr. Overcash focuses on the development of the Mississippi Tort Claims Act and how its historic context should be emphasized in asserting immunity from liability for governmental clients. The article outlines the principle of state sovereign immunity and how advocates can strengthen its application in defense of clients by providing the court with an explanation of immunity as it developed at the founding of the nation.
